RE:      Tax Title/Foreclosure legislation

Dear Colleagues:

The legislature recently passed, and the governor signed, the FY 2025 state budget.  Included in the budget are several sections that make significant changes to longstanding Massachusetts tax title and foreclosure processes.  These changes are in direct response the US Supreme Court decision in the case of Tyler vs. Hennepin County, as well as two Massachusetts trial court cases issued earlier this year, specifically addressing the constitutionality of the current Massachusetts tax foreclosure process in light of the Tyler decision.  Collectively, those cases prompted the legislature and the governor to act.

The MCTA leadership and our government relations advisor, John Fernandes, have worked over this past two-year legislative session, in close coordination with the MMA, to advocate for a balanced and revised process that is fair to both to the taxpayer who is in default on tax payments, as well as to the municipalities. 

The process set out in the bill does reflect several of our suggestions and proposals.  There remain some provisions we hoped would be added, deleted, or clarified before passage.  We thank the legislature and governor for their efforts and will continue to work with them to address what we consider to be further needed changes.

The effective date of the legislation is November 1, 2024.  That gives us three months to gear up for this process.  Please mark you calendars for the following educational opportunities that will further highlight these changes in the law:
